At last Council meeting I gave notice of a motion that we should support the Anti-SLAPP legislation introduced in June. SLAPP suits (Strategic Lawsuits Against Public Participation), or the fear/risk of such, are very effective in tempering the degree to which citizens challenge applications for development. This risk is there as usually the proponent is a Corporation with “deep pockets” which can fund legal costs for a law suit whereas the citizen and/or group of citizens do not have access to such financial support. The fear of a lawsuit intimidates and essentially squelches public discussion, freedom of expression.
Other jurisdictions have implemented such legislation. In 2010 in response to calls for such in Ontario did establish an Anti-SLAPP Advisory Board; that board has recommended implementation of legislation.
Council will vote on my motion at 7/8 Council. Here is the motion.
